husband moved to a rented property, can he take away furnitu

. our marital home is in joint names of both me and my husband with me as the first owner as i was paying the emi  till nov 08 after which i quit the job and became a home maker.
my husband has been pressurising me to sell the house so that he can apportion the money to buy two smaller flats one in the name of his mother and the other in joint nmaes of himself and me with him being the first owner as the second flat would be mortgauged and the loan would be on his name.
after this a simple fight was magnified abetting me to suicide and my husband left the house and promptly lodged an fir saying that i attempted suicide for threatenig him. which has failed because i have come back with the kids to my marital home and i am staying there since

now i hear that my husband has rented a flat for his mother and they both are leaving there.
i am not interesting in breaking the marraige, even though he has every mind to do so
please let me know the following

1. can he come and take away furniture and other articles from our marital home

2. he had paid maintenence for one month and now he is just dodging the same and delaying payment saying he will give today tomorrow.

yes he can, because it is his home also.  But you can get the remedy, if you are ready and willing.  That is you should take the help of an advovate there in the locality and file a complaint under Domestic Violance Act.

don't file any complaints as that will shatter ur relationship beyond the point of repair.  so if u really want to stay in this marriage don't go for DV or any other complaint as after that all hopes of ur uniting with husband will die.  try to solve ur problem first of ur own by just talking to ur husband.

i have two chi;ldren and i am not working so if they take away the necessary articles how will i maintian myself

FIrstly decide whether relation with ur husband is more imp or not. if u want to damage relationship permanently u can go with lawyers advice. otherwise take him with u to counselling. DV and 498a both are powerful weapons like brahmastra given to wemen by law,but if you want to save relation dont use brahmastra without trying conventional weapons.

therefore act accordingly.

i guess that your husband getting pressure from his mother and her family supporters. now it is upon you the spouses - how you will solve it,

do not think that only you have the weapons of 498a, dv, crpc 125, the said mother also may use these weapons.

therefore it is wise to meet the problem - within the home with an  amicable settlement.
