Husband stopped giving maintenance

While living together question of maintenance does not arise.  If there is a wilful negligence by the husband to maintain his wife then question paying maintenance arises.

If she did not file a case u/sec.125 Cr.P.C. in a Magistrate Court then file the same,if she has already filed the case but her husband is default for paying maintenance then submit a petition in the same court praying for Warrant.After issuing the warrant if the husband is still absconding then file a Petition u/sec.82 and 83 Cr.P.C. for attachment of his property if any.

Dear Querist

 is any court pass an  order for maintenance or not? if yes the wife has right to filed a execution u/s 125 (3) of Crpc and get an order to attachment of his property or himself.

if there is no maintenance order, file a maintenance petition before court and get maintenace order, if court think fit and just to pass an order.
