Recently i got the order copy of decree of nullity U/S 25 of special marriage act. Null and Void petition was filed by my wife under the willful refusal to consummate the marriage on behalf of respondent ( here respondent is me). Session judge passed the order in favour of my wife, but session judge has not granted any monetary relief or reliefs, my wife asked for. The mat suite was ordered without cost.
Here it is significant to note that our marriage has never been consummated and my wife never came to her matrimonial home after the registry marriage.
Now my question is after the decree of nullity under spacial marriage act is she is eligible for maintenance????
If she file a fresh petition for maintenance well she get the maintenance????
