iNCOME TAX REFUNDS

LAW NEWS:

49 lakh cases of income tax refunds are pending with the revenue department

LOGAN VIEWS :

In fact, Govt to devise a policy to adjust the Refundable portion of the previous year with the Payable portion of the current year so that the Assesses can be benefited instead of waiting for the Receivables from the previous year on account of excess Tax paid.

I agree with you on this issue.

In fact for past few years there is a discussion within the policy makers to devise a PAN based running account akin to a current account wherein all payments and refunds are accounted for and adjusted against the tax liability.  let's hope it comes in  final shape soon.

Sir,

I have filed a civil suit for dishonest delay of refund for assessment year 2008-09 by Income Tax. The refund said to have been paid on30.6.09 was actualy paid on 16.3.10.They have now come up with a plea of good faith u/s293 IT Act,'61. Is this tenable? Let me know with supporting judgments.
