Indian subordinate JUDICIARY

The state higher judicial service is now in a flux. previously it was only on seniority that the promotion to higher judicial service was made. now after MALIK MAZAHAR case it is being done on viva voce , ACR, judgments . it is purely subjective. it is found that a candidate securing more than fifty percent marks in the viva voce in jump promotion has been awarded zero in the viva voce in the suitability test. moreover it is not clear whether ther merit test includes suitability test then how the selection is being made merit cum seniority is not understood as one getting say 30 marks in merit test is not given any credit so far as merit is concerned as merit test includes suitability test which one must qualify for his merit and seniority to be considered.

the question remains is this procedure for selectiion is just and proper?
