Is it possible to send two legal notice by plaintiff?

Plaintiff filed an ejectment suit under tp act 106, by issuing two legal notice (advocate notice) dated 29/10/2009 and 10/11/2009. Both the notice were marked as exhibit. Is it possible to send two legal notice by plaintiff?

Can i take any defence?

Please suggest.

Let the court decide which one to be accepted.

It is madotory to sent legal notice for eviction of tenants. The said notice is statutory in nature otherwie you cannot prosecute the tenants.Their is no bar in issuing 2nd  legal notices. However one has to be prudent in marking the required legal notice which suits his case.

However if the second notice is not properly drafted or is indifferent to the earlier one , the defendant may use such document (legal notice) to contracit your first legal notice.

If sufficient time is given forvacating the property as contemplated under T.PAct as per the later notice and then the suit is filed. It is valid.  i.e 15 days clear notice ending with the month in case of monthly lease etc.
