Is oral evidence mandatory in Maintainance case

My sister has filed a Maintainance case and she also filed a written affidavit, nor it has been posted for argument ... but the new judge says that the oral evidence is mandatory in Maintainance case ... if yes then whole process happened till now has to be reiterated again, it has already been 4 years ... kindly help me in this regard ...
