judgments and case laws on motor accident cases and compensention

mr john was travelling in a bus from mumbai to pune suddenly bus brakes were failed and accident is caused john suffred head injury and admitted in hostital suddenly he went in comma and died .mrs john filed claim in tribunal for compensention on behallf on his minor daughter and herself  .john was sole earning member of his family he was working last 20 yrs and his age was 47 yrs .mr john left behind his wife and minor daughter and driver was holding invalid license during the accident my question is that who is liable to pay compensention and how much compensention can be claimed

i want some judgements and caselaws related this problems and important points

sir please explain how can  bus company will be liable to pay compensention and why not insurance company pay the claim ?

If it is legal and you have a proof of the same then as per the law you can claim for a minimum of Rs.2000000/- and you will get atlist Rs.1200000/- to Rs.1350000/- with all the heads.
