have you nt take any action or your family not ask to your husband single time why he not came with her and not live with your family in his house 

have he pay you any money for tis time or not and what is good reason behind he not came back 

plz clear all and first i suggest you you need to help your older family member in this case and solve matter with talk 

if not than you file case in sec 498 for curlelty and sec 125 for maintaince

My opinion : before filing 498a sec 125, try to solve issue by talking to elders in both family, if not first send a lawyer notice and again try talking via elders. Also first start with asking him to pay for expenses and if that happens then you can ask him to take her back. One step at a time. Try not to threaten, cos that won't lead to any good. Don't openly reveal your plans for filing cases; rather keep it calm. All the while keep recording his statements using a mobile phone "audio recorder". Collect evidence that will be useful against him. Finally if all attempt fails, then file the cases! Make sure you have tried all routes before filing the cases, cos once the Legal battle starts, it is officially war and you are enemies and no going back for your sister and her kid to husbands house. Keep that in mind.

First try to sort out matter with the help of elders. If it fail and your sister want to take legal step then she can file RCR. Dnt file any other case accept RCR if she dnt want divorce.
