Land bought in lucknow from sc/st

Dear Sir,

I bought a land in Lucknow from SC/ST in 2005 not knowing the Caste of the person. Now in year 2015 i came to know that the land was bought from SC/ST. I have all the registration document but the mutation was done at that time.

What legal process i can go through to have a land sold or acquired or build something in it. Is there any way i can save that land.

A suggestions or reply is highly appreciated.

Regards

Vasi

There is no illegality if you have purchased from titleholder (irrespective of caste). However, show the document, including chain of title to a local lawyer and seek his professional advise.

Dear the following two key points may be of some use.(a) Is the Land proposed is from self earned category. (b)Whether the land proposed to be acquired is in the nature of Ancestral property has not been clearly stated. In Normal Practice,The person who hold the Original Documents, is treated as bonafide one.You may kindly get going,by approaching the Registrar Concerned, and seek the desired relief. With best wishes from slakshmanrao3@gmail.com

Thanks Mr. Vashista and Mr Rao for giving me Advise. I have bought the land from title holder. But i am from General Category. I know now that land bought from SC/ST cannot get mutated in my name. So what is the way forward. I am trying to contact a local lawyer for his advise but at the same time i am trying to get some light from experts in this issue.

Original Documents will show the right way, provided the proposal to acquire the property is in the nature of Self Earned Category...

T. Kalaiselvan, Advocate (Advocate)     14 May 2015

Ther is no legal infirmity buying a land from a person belonging to the SC/ST community if the property was his self acquired property and not a free allotted land by the government under social welfare schemes. For knowing the nature of property and other issues, the related documents/.papers are to be seen, hence consult a local lawyer for proper opinion.

Substantially a prudent observation and opinion from the expert Learned Mr. T. kalaiselva. I agree with his views.
