Land occupied

Dear Sir,

Our plot was occupied by the next plot owner and we filed a case in the court...

Below is the brief of our case:

We have a plot  area measuring 20X60 sq.ft in our native pondicherry...It was occupied by the next plot owner by building a small house.His name is MUNUSAMY.  When ensured it by applying to survey dept and they confirmed it was our plot occupied by them..When we approached them, they were not ready for the settlement. So we filed case in pondicherry court in the year 2005..It gone for lot of trails, but the opponent did'nt appeared in the court, Court has also verified by measuring our plot  and  exparte judgement  was given in the year 2010..This judgement copy was sent to the opponent, they did not collected for twice and at the third time they collected and appeared in the court. Meanwhile in the five years, munusamy dead , so our lawyer added his wife and their sons..The opponent has appeared in the court and request for permission, applead again...when we asked our lawyer he said it will be over in 1year..But till now no satisfactory result...its keepon continuing with no end.

This plot is in the name of my mother aged 65years...

Please suggest how to proceed further...Is there any way to close the case fast considering senior citizen??

Note: At the time of filing case,they had built a hut house...but during these years of trial they have changed it to concrete house...

Devi,

In your case ,with my practical experience ,You have to initiate necessary criminal proceedings against the illegal occupants .

one good approach is filing a criminal complaint with the  Land Grabbing Special cell, Puducherry.

With the help of an advocate draft a complaint and lodge it to SP of Puducherry or to the Land Grabbing Cell, puducherry.

I have my second opinion in going for criminal complaint, as already civil suit is pending, it will be a good opportunity for defendant to take maximum advantage of the situation, I still advice you  to request and follow up with your counsel to speed up things in the court.
