Land partition brothers

My father are three brothers and all three brothers bought a land and built a house. All three brothers have equal name in the property. Two brothers died. My father is alive and put the case as equal division of the property (batwara) among all the three brothers. And after fighting the case for one year almost judge dismissed the case.

can it be possible? Is my father can not appeal for his property rights? He qppealed for equal division and then also judge dismissed the case.????

If your father and uncles had jointly owned that property, now your father is sole survivor and owner of that property. It seems that property is not ancestral nor was self-acquired by any single of the three, therefore your father can simply himself arrange a family settlement deed and divide the property equally and transfer shares of your uncles to their respective descendants.
