Law regarding maintenance deposit in new property

I need to ask that can a builder use Maintenance deposit collected from its members or he is legally bound to keep the above said deposit as fixed deposit as member allottees money & can use only interest part on Maintenance of common areas for flat owners & is bound to hand over the maintenance deposit money when the builder decides to hand over maintenance work to welfare association after completion of the project. Pl. elaborate legal position liability of builder Any court decision in this regard perhaps there is one for DLF Builders

Assuming the property is in Maharashtra in that case MOFA applies and section 5 and 6 speaks for itself.

thanks for the information but this is the case of Grugoan DLF project. if there is any law in delhi ncr reason please let me know..
