Lawcommission india 498a compoundable

Please visit the website lawcommissionofindia.nic.in and read the 243rd Report on Section 498aA IPC.

Its not only shocking but shame that it states the 498a to be made compoundable and not other changes needed and definitely not going to be bailable.

This law is only for dowry related problems and if a wife is harrassed or tortured for dowry then the crime is already committed and there is no need for compromise if its true then what is the use of making it compoundable.Does that mean the wife has all rights to pull back the case and she can sue to as a tool for blackmailing the husband and in-laws.

Why the law commission is not specific about the word compoundable,they should fix a price for such kind of settlement as in western countries brothels have fixed amount the same way the law commission should also fix a rate for these 498a wives instead of using the vague term compoundable.

Dear Mukund, the pace of amendments in various laws of India is quite slow.

 

Unfortunately there is a lack of proper Research and Development in this direction.

 

Further, the Law Commission merely recommends for the changes otherewise the power lies with the Parliament/ Legislature to do the needful.

 

Certainly there is an abuse of the aforesaid Law, unfortunately the people in India are not aware of the ultimate impact of the litigation.

Sorry state of affairs, the people are required to be taught first.
