Leave and license validity

Validity of Leave and License agreement

I rent my shop three years ago in Shimla . we (me and tenant) strictly agreed for the duration of three years only after that i said i will take the shop back for my use.i have made Leave And license agreement with the tenant. Now he is not vacating the premises and neither agreeing on new rent amount. it is clearly mentioned in agreement that premises is given for use and occupy on license basis for three years only and after expiry tenant has to leave the premises. kindly tell me how valid is my Leave and license agreement .Agreement is on 50rs. stamp paper and attested by Executive magistrate. how much time it will take in court and what are chances of winning.

Consult a lawyer along with your agreement copy. He will send notice to vacant the premises. If he responds to your notice you can then fight the case and in the interim you can get a notice and orders from a district magistrate to vacant the premises and you can approach the police station for help.if mentioned in agreement you can put a lock on your premises by vacanting any persons in the flat or shop.

Any agreement with registration before the sub register that is valid. Without registration of the agreement is in valid. Now you can file civil case and also one money suit. But you have to produce all the documents which you can proof. You may show that agreement but how long that help you your local lawyer can say.
