Legal Dowry !!

The women and child development ministry is seeking an amendment to Dowry prohibition act 1961 to make it mandatory for couples to notify the list of gifts exchanged during the wedding.

The list of gifts , in form of a sworn affidavit has to be signed by a protection officer or a dowry probition officer and kept by both the parties. failing to do this can invite heavy penalty including a 3 year term in jail for not only bride and groom but their parents also.

The above amendment is likely to be introduced in the budget sessions of parliament for approval.

Dear experts need ur valuable suggestion how it helps both the parties and do u feel that this amendment will be useful for protecting 498-A / D.V for the husbands ? so that wifes family cant simply say that they gifted loads of jewellery etc to grooms family which actually they have not gifted and can avoid the false complaints.

This is a very positive move from NCW after a long time...This definitely helps husband and his family  to safeguard themselves from unnecessary blame from Bride's family.  But I don't think this would be helpful in suffering false 498a/DV, because these sections deals with other allegations also. But very curious to listen our Legal friends opinion on this

this is a good move as in fake 498- a cases the list given by lady side is usually exaggerated and exhorbitant.

Marriage is agreed between parents in a festive mood without thinking about a bad relation ship in future. So such a list of movables and immovables may not come in the list in full trext. Further parents may not like to publish the actual quantum of money, ornaments, shares etc given to their daughter. I don't thing for practical purpose this may not serve good in Kerala. Becuase here in Hindu community  marriage is sacred affair.  In Chriatians they give a nominal details in the Church records. That is a negligible list. Muslims they declare a false figure in open at the timeof the marriage. I don't about the other states.
