Legal help reuired

I met with an accident. I was not at fault. the auto rickshaw coming at full speed from opposite direction hit my car. Auto rickshaw driver run from the spot as he was at fault and he was overloaded. the passenger of rickshaw went with me to hospital. we both was minor injured, so after giving first aid, doctor has discharged from hospital. After 1 hour i received the call from one of passenger that do compromise otherwise we will file police complaint. As i was not at fault, I told him that i am not at fault and whatever he want to do he can do. i have a recording of this call. After 1 month, i received a notice from police station that fir has been filed against who is driving the vehicle having registration number so and so under section 279 and 337 ipc. I was shocked when i saw the fir, it was written that after making accident i ran away from the spot. but the truth is that there is record in the hospital that i have taken the treatment in the hospital along with all the passengers sitting in the rickshaw and i have recording of the call which i have received from one of the passenger and truth is autorickshaw driver ran away from the spot. Police has filed a charge sheet against me. I am very tense. What shall i do and what are my chances of winning the case.

During police enquiry you can tell to the police clearly, according to the  chargesheet may be submitted into the court by police. You can argue in the court of law, when the case comes in to trials.

Actually you did not lodge FIR within time, hence all this mess against you. Don't bother. You can lodge now. No.2, You must collect all the records from hospital about treatment and injured persons and contest the said case with counter claim. Consult a computent lawyer.
