Legal impediments for adoption

A woman has a son from her first husband and the first marriage has been dissolved. The woman further married to a person, but the second marriage has not been registered yet. The second husband is intended to adopt his wife's son from 1st marriage. The said son is at present 13 years old. What should be the legal impediments in such adoption process? And what are the remedies
