Legality of holding the salary during the notice period

Hello there...

Can anyone help me out in the followin case:

I placed my resignation on 2nd July, 09 with willingness to work for the notice period...

Now the company holds the payment of salary for June, 09 and for the notice period of 2 months saying that the company has a policy of making all these payments only after you are relieved..which in my case would be after 2nd Sept, 09

Is holding the payment of salary apart from notice period in such a manner legal?

Please help me out

and the important fact i came across today moring from my appointment letter is that am still on probation period and there is no such notice period required in such a case...

Please help me out to fight against such a harrassment of the company

Hi Pankti. If you are still in your probation period and your contract of employment is silent on any notice period then you can terminate it any time with-out notice and the company has no right to retain yourb salary . Thanks .
