Loan noc

One client had taken loan before some years ago and fully repaid by such client in 2007 from city bank but such client was not received nos for such repayment from city bank due to closure of such branch. Now my client approach loan for bike from SBI branch but bank says that he has outstanding loan of city branch Rs.16127/-hence civil proceedings impose on him. So my quary is how to remove civil proceedings for such outstanding amount so that fresh loan from SBI can be availed.

Hi! First off, from this statement, "Now my client approach loan for bike from SBI branch but bank says that he has outstanding loan of city branch Rs.16127/-hence civil proceedings impose on him," I'd gather that the bank is denying loan to your friend as their assumption based on the lack of NOC is that civil proceesings may be initiated against him.

As to the lack of NOC, note. When your friend took a loan, he must have recieved a statement from the bank detailing timely extent of the loan, the amount payable per month with interest, total number of instalments etc. Moreover, upon every payment of instalment/monthly deduction, the changes would show in his bank account.

All he needs to do is approach another branch of City Bank (as upon the closing of the branch in question, his records would have been transferred,) and request them the past records of his bank account (in the course of which he made the repayment,) as proof of civil proceedings are initiated, moreover he needs to issue an afresh NOC/clearance from the bank.

The borrower must be having details and docs pertaining to loan; brochure/application/agreement/statements/payments made etc etc and if total amount was paid in time(without delay and resultant interest) then borower may write to HO of the bank and close the matter once for all.

If there is NO branch of bank or if bank has closed then write to regulator say RBI.
