here a couple of other questions have to be considered before a certain answer is given, as the information you have provided is not sufficient.  For a proper reply, you are required to furnish certain information like (a) where the flat is situated i.e. the name of the city / District? (b) Which Development Authority is there? (c) Whether the flats have been constructed after getting all due sanctions?  (d) Whether the map is duly sanctioned? (e) What rights have been given to the owner of the top floor? (f) Whether he has been duly authorized to get the shed constructed or not? If not, then the complaint can be made to the Development Authority as well as to the Police. It is totally dependent on the terms and conditions and authorities given to him vide the sale deed executed in his favor. Good Luck.
