Maintenance under crpc 125 & dv act

Dear All,

In my case Crpc 125 is running in Family court since 2006.No, Intrim maintenance granted by court as she is earning & qualified.Her salary slip had been submitted in court.The case is now almost to finish....

Now,with same juridiction Dv had been filed in Sep-2011.

What should be done in DV to avoid her demand regarding maintenance.

Please provide me any judments regarding this.....

in a similar case,delhi highcourt had given decision.....MULTIPLE MAINTAINANCE IS NOT ALLOWED.REGARDS

The trial court where the DV case is filed..will not listen to you...you have to approach HC under section 482 CrpC for quashing of the Proceedings under DV act....

Provide all the certified copies of the doucments on record of the 125 Case in the application in HC..

My mother had the regular bail, while I had a conditional bail.

we don't have the bail papers with us. should we approach the court to get the bail papers or the advocate? pls advise.

If maintenance is granted in her crpc 125 case,submit the order copy in DV case to avoid double maintenance.Counter allegations in DV with your reply.

DV will not get quashed by HC just because crpc 125 is in progress.

AS she is earning & qualified & her salry slip is submitted,no interim maintenance is given by family court since 2006.

File reply to DV with same arguments.
