Malicious prosecuition

MY question is as:

my 498A is running from aug 09 , no MLC i won sec09 RCR now police gave me a copy in which is mention that

" प्रभारी परिवार परमर्श केंद्र की सुब इंस्पेक्टर को मेरे खिलाफ बिना जांच किये गिरफ्तार कर जय भेजने और केस में ;लापरवाही बरनते का दोषी पाते हुए निंदा के दंड से दण्डित किया जाता है"

क्या ये ४९८अ में उसेफुल रहेगा.

हमने अभी सेक २३९ का रिविसिओं फाइल किया है.

1. Such internal prosecution copy which you have hold of now as you say in your brief, paves ways for you not only for charging Police against malicious proceedings and seek (i.e. civil as well as criminal) damages – compensation and the FIR - CS itself is liable to be quashed provided you have a seasoned criminal advocate besides your side. You have informed earlier to this forum that your brother - uncle is a criminal lawyer so implant this remedy.

2. Some dozen months back I mentioned about a Mumbai HC judgment, where similar events happened and parents of accused son (in a S. 498a IPC) got relief from State of Maharashtra. Dig that reporting of mine here in LCI and may read it down so that you can put your next act in order.
