1.I think this act will amount to adultery because the object of law is to prevent illicit relationship.

2.Wife cannot file case against unmarried woman.

3.Court can issue rcr and it has to be followed. If not followed it will amount to contempt.

Dear sir,


My friend named srinivas, married at the age of 18. He was not interested in that lady he married from the begining. because of his parents he married that 15year old girl. As the time passes he loves a girl who is his classmate. He adjusted with her that she should not know his back ground, this went on for 10years. But recently he wanted to marry her and that girl parents came to know that he is already married. Now my question is:

1. Can this act is called as Adultery and is it can be punishable to that man??

2. If that girl commits suicide any punishment will be given to that man under Penal Code, If yes, under which section??

3. Is it possible to file a case against that man by his wife??

4. He is accepting his guilty is there any chances to cutdown the punishment?/

5. Is there any chances to save that girl who is in love with that man??

scope of 498a got broadened and its now filed for any harassment including extra marital affair but the intensity of te affair should be harsh enough to drive any normal woman to suicide. Doesnt mean she has to commit suicide but it means that it should be of such verocity to drive her to contemplate suicide or how much psychologically affected she is. This happened in Sweety's case that she has narrated in her personal how much she suffered due to her husband's extra marital affair on a daily basis. Her husband was convicted for abetting her suicide. SC is saying that there must be direct correlation between the cruelty the wife suffers and the extra marital affair. If the wife can prove this correlation beyond reasonable doubt then the husband for sure will be convicted. The wife can narrate how much cruelty she suffered because of her husband's extra marital affair. In addition to that, she can try to collect evidence if the husband guy is with other woman for just pleasure or for money too. If he is after her money/property and you try to pull words out of his mouth then you can claim dowry harassment that your husband is not living with you for want of dowry and since he is with other woman for money. if the marriage is so short lived like say 2 or 3 months or less than one year and if the husband's affair with the other woman had started even before marriage then she can even file IPC493 if she can just manage to get these words out of the so called husband's mouth "u r not my wife. i never wanted to marry you" or "this is not a marriage" or something of that sort.

https://indiankanoon.org/doc/920902/. this is a very good Supreme court judgment where the husband guy is ordered to take her back to matrimonial home and lead life as husband and wife else she is at liberty to convict the husband for contempt of court. Please file RCR and try to quote this judgment to get a favorable order and to get order for the husband to take you back to your matrimonial home.

we deem it proper to issue to the appellant husband and respondent wife both:

1. That the appellant husband Prakash Kumar Bachlaus shall take back the respondent wife Smt. Chanchal alias Jaya in his matrimonial home and start living with her as husband and wife and provide her the normal peace, love and affection of a matrimonial home.

2. We also direct the respondent wife to perform her marital obligations in a peaceful and normal manner and take care of the needs of her husband and her family members in a peaceful and cordial manner. She is not supposed to cry on the roof top, as it were, about her victory in this legal battle at this forum and she should understand that living peacefully in a harmony in a family is more appropriate behaviour in view of overall peace and good atmosphere required in the society rather than broken marital homes and acrimonies of such unfortunate litigations.

3. That the appellant husband shall deposit a sum of Rs. 1,00,000/-(Rs. one lac) in the form of fixed deposit in the name of respondent wife with any nationalized bank within a period of 15 days from today and handover such fixed deposit to the respondent wife as a compensation for the long number of years which she was compelled to live separately and away from her marital home.

4. That the appellant husband shall or for such period for which he does not take back the respondent wife in the matrimonial home and start living with her from the date of this judgment shall pay an ad hoc monthly maintenance of Rs. 7,000/- to the respondent wife in cash or by account payee demand draft in the first week of every month.

5. That if within six months of our judgment and order still the appellant husband does not take back the respondent wife in the matrimonial home and start living as husband and wife as directed above, the respondent wife shall be entitled to approach this Court by way of contempt petition."

and if yes then which way for escape form both side ( specially for marriedge man ) ?
