Maternity leave

Hello,

My wife is a primary teacher in a private (non Govt aided ICSE) English Medium High School. She's been with this school for more than 7 years... She delivered our first baby in May 2015.(The school was informed of the pregnancy and indicative delivery date, last year it self) ...This is the summer vacation time (End of Arpil to 2nd June 2015)for the school. Is my wife eligible for 180 days of maternity leave, and is the summer vacation period included in the 180 days of maternity leave ?  What can we do if the school refuses to give her paid maternity leave ... 

I would really appreciate your valuable responses and suggestions..

For the Maternity Benefit Period of 90 or 180 days you need to check the Maternity Benefits as applicable to the establishment, from establishment/employee’s-teachers association or Forums/ICSE affiliation rules and service conditions narrated therein/State Education Act etc.

 

Assuming that Maternity Benefit Act applies to the establishment and establishment has agreed to provide 180 days Maternity Benefit:

 

--As you have posted that you have informed the school of the pregnancy and indicative delivery date, last year it self, then school should have paid the maternity benefit of 6/12 weeks in advance and of 6/12 after having informed the pregnancy delivery. The rate of Maternity Benefit, and time of making the payment is defined in the Act and it shall apply.

 

--The bonus of Rs.3500/ may also be applicable.

 

--If the pregnant woman employee suffers from sickness due to pregnancy delivery then she is entitled to 30 days Maternity Benefit also.
