Maternity leave

Friends,

 

Where it is given that unaided educational societies are covered under this Act?

 

We are registered under THE BOMBAY PUBLIC TRUST ACT, 1950, THE trusts comes under Shop & Establishments Act. We are in Pune so we comes under Bombay Act.

 

It is clearly mentioned in aforesaid Act that Educational Institutions are exempted under this act as per schedule - II (Exemptions). But you people are advising that we are covered under Maternity Benefit Act, 1961.

 

Do you have any documentary proof or any other supporting document.

Dear BD ROOPCHANDANI,

Under Maternity Benefitss Act  1961, there is no such exemptions to an educational institution, it does not mater whether it gets any aid from govt. or not.

Dear Eswari Rajesh,

If you are a full time employee you are eligible for Maternity benefits (maternity leave and cash benefits). Denying maternity benefits to eligible employee is an offence.

I am not telling exemptions under MB Act, 1961.

 

Educational Institutes are exempted under THE BOMBAY SHOPS AND ESTABLISHMENTS ACT, 1948, please refer Schedule-II (Exemptions).

 

If its not come under shop n eshtablishment then how Maternity Benefit Act is applicable.

Why are you relating these two different acts ? These two acts are not inter dependent.

Yes these are inter related because MB Act is applicable on Factorieis, Shop n Establishment ect.

 

If education institutions are exempted under shop n eshblishment then Maternity Act will no be applicable.
