i am expecting your valuble suggestion for my friends mcd case. his name is rakesh. and his wifes name is sheela due to incompatibility they have applied for mcd in 2013. his mcd case details are mentioned below:
1.mcd case filed on 4.10.2013 through common lawyer for both partiesand lawyer arranged by common well wisher and relative to both families.
2.prior payment of one time settlement of permanent alimony of 25 lakhs outside court prior to filing of mcd petition in family court in chennai.
3.lawyer filed all mcd documents and neglected to file payment receipt of 25 lakhs along with other mcd documents.
4.lawyer also neglected to note down about payment of one time settlement of permanent alimony ;outside court in mcd petition.
5.his wife does not attend after 6months of filing mcd petition to file affidavit except very few appearance.
6. 18months elapsed since filing of mcd petition but wife does not appear and file affidavit in support of mcd.
7. husband attended all hearings in family court upto now and in dire need of divorce decree.
8.next hearing on 6.6.2015.
9.what husband has to do so that he will be sanctioned mcd divorce decree by family court?
