Medical laboratory staff pay scales related matter

Can any one please advice on the following service matter related to central Government health employees i.e. Medical laboratory Technical Staff of different Central Government Hospital in Delhi like Dr. RML Hospital, Safdarjung Hospital, LHMC, KSCH and SSK hospitals.

1.       There is no uniformity in service conditions of medical laboratory Technical staff in central Government hospitals/institutions throughout country. There are different designations, Pay Scales, promotion avenues and also have uneven entry qualification in profession due to absence of any central statutory body like Pharmacy Council of India for Pharmacist, Indian Nursing Council for Nurses is in existence for regulation of Nursing and Pharmacy professions.

2.       In reference to establishing uniformity in pay scales 5th Central pay Commission had recommended Grade pattern for lab staff like Lab Technician Grade-1, Gr-11, Gr-111 which was implemented partially by Central Government as Ministry of railway, Defence and some subordinate institutions of health ministry have implemented these accepted recommendations but other major institutions under Union health Ministry (nodal ministry) have neglected these recommendations and neither Recruitment Rules were amended nor pay scales were upgraded as per given recommendations.

3.       6th CPC has also given recommendations on the basis of 5th CPC recommendations by apprehending that earlier recommendations have been implemented.

4.       This has created a uneven picture in terms of pay Scales and RR despite the fact that all these professional have similar basic job profile, have similar nature of job, professional skill and responsibilities as all are these hospitals are providing the similar type of diagnostic services of Patient care in all departments of laboratories, Teaching, practical training and education and research for under graduates and post graduate medical students. Say for example presently all above mentioned hospitals being hospital and medical colleges have similar basic departments of Laboratories as per MCI Rule regulations means catering the similar diagnostic/laboratory services. Further Clinical laboratory services support each and every system of medicine, department and disciplines of heath care.

5.       Presently RR are very outdated, 30-40 years old which does not reflecting the actual job profile of these professionals in RML, Safdarjung, KSCH, LHMC while on the other side some institutions like PGI, NICD, NMEP have amended their RR and pay scales.  Administration of these institutions always argue that there can be no uniformity in pay scales as RR are different in different hospitals.  

Now I would like to know is there any legal ground in CAT for this matter seeking uniformity in service conditions like up gradation of pay scales and RR?
