Where mother and father is in judicial seperation and child is in custody of mother, she can give consent for the same.

If they are judicially seperated then who has the legal custody...else father takes the call...But if it is so important then why do you think that it can be disputed in future?

The person can give consent for the surgery of the child  in whose custody child is.

Thanks a lot.. This issue seems to be similar to RBI vs Hariharan case 1999. Same logic can be applied here also.Regards
