Membership of Bar Council

 A lawyer on thre Bar Council does not practice law but is an active partner in a firm signing agreements, filing income tax returns, issuing cheques, communicating with companies as partner of the firm. He also claim in his I.T. return certain income as "professional charges" received.

Can such a lawyer be on the roll of the Bar Council?

An advocate cannot be on a payroll of any company or an active partner in a partnership during his enrollment with Bar Council.

He should intimate the Bar Council of his employment.

Once he joins such employment either of State or Central or corporation etc, his Sanad or Ceritificate becomes a dead letter and he should intimate the Bar council of hia State. Further, there is question of Disciplinary action if no intimation is made to the Bar Council, but leave that mater to the Bar Council.

He can not be practising advocate.
