The police are bound to register an FIR. Section 154(3), CrPC lays down that if the officer-in-charge refuses to record the information, the aggrieved party may report the matter to the superintendent. If that doesn’t work, that’s to say they haven’t begun the investigation into the matter, the aggrieved can further file an application under section 156(3) before the magistrate concerned. The magistrate will both direct the registration of FIR and opening of the investigation. (However, note, the magistrate cannot interfere with the power of the investigating officer.)
