Money recovery suit

I have to file a money recovery suit on a person.

Have the following proofs:

1. Email request asking for 8L.

2. Bank transfer records.

Can a summary suit be filed?

How does a money recovery suit proceed?

Serve a demand legal notice first.

Firstly consult a lawyer and get issued a legal notice and if notice is not complied then file summary suit for recovery. Sidharth 9811776422

Yes you have to demand from person. So send demand notice through advocate.

Is it possible for me to serve legal notice, without the help of advocate? If so, how is it possible.

You can file Summary Suit even without serving notice. There is no specific requirement in CPC to serve notice before initiating Summary Suit. There is no specific format in which Notice is required, if you desire to send notice than just narate the facts of your case and demand the amount that is due to you.  

According to my understanding the point to be taken into consideration is whether your claim is within the time limits ?

a person had borrowed money from my freind.. they had agreement written on plain paper with revenue stamp pasted for legal action if the money is not return back... now the person refused to return the money... how can the be recovered...?
