Mortgage of building

Hi Friends,

Please help me out here... If a building has been constructed by the lessee on a leased land which belongs to the lessee, can the building alone be mortgaged without the land? lessor is not willing to give permission for security creation but the building on the land belongs to te lesse. This is a reverse situation where for a equitable mortgage, if the land is mortgaged, the building is mortgaged by implication even if the title deed does not specify the same. Please revert as soon as you can.

Dear,

This is like m selling u a mango tree but u are not entitled for mango.  There is no question to lease ur building alone without land.
