motor accident cases

a person driving a taxi who posses licence to drive LMV and dashed a pedestrian. now the pedestrian file an application  for compensation against the owner of the taxi and the insurance company. the insurance company defend the application that the driver of the taxi did not possess valid licence to drive the taxi i.e passenger vehicle and that they are not liable to pay compensation.  so, please give citation with regard that the ins co also liable to pay compensation or they may pay and recover the same against the owner of the vehicle
