Mumbai-sra development

 

Godown Premises of 1725 carpet Area- Ground floor Independent Shed  Lorry touch motarable premises-   at 1,Mumbai 12.

Prsntly being developed under DC Rule 33.1 which say we will get only 225 sq ft & over that we have to buy at Market price.

·         Original tenants of  Rustomjee Trust  since 1930

·         Property acquired by BMC from  Rustomjee Trust in 1960 for making Nurses Quarters opp KEM Hospital, so we became automatically attorned as Tenants of BMC.

·         We continued to pay rent to BMC till date, with facilities of water & Electricily

·         In 1966 we received a letter by BMC for Alternate accommodation for the making of Nurses Quarters, but the project was delayed for reasons best known to Corporation.

·         In due course Slums developed all around our premises.

·         In 2000 we receive a notice from Additional Collector to vacate the premises in 48 hours.

·         On inquiry we are told we are VLT (Vacant land Tenants) & VLt don’t have any protection in a SRA scheme which has been passed.

·         ·         Other Slum developers object to the scheme & take  Builder to court-I,e Sessions, High & Supreme Court.

·         We follow up with BMC & Records from 2000- 2006, after which then Jt Municipal Commsr sanctions our status to be changed from VLT to Commercial Building Tenants occupying 1725 carpet Area as per the Award Copy.

·         Asst Commissioner writes 4 letters to SRA to change status on Annexure 2 but no action or movement from SRA side.

·         2010- Supreme Court Gives judgment in favor of Bldrs & Slum Opponents Loose the case of which we are part of it.

·         Apl 2010 we receive a notice from BMC for vacating within 48 hours.

·         We write back to BMC & BMC verbally assures us we will not be demolished as we are Official Commercial tenants of BMC.

·         12th May 2010 along with the opposing slums we are demolished with our stocks & records.

·         We appeal to High Power Committee to hear us where in our case no is 117 lodged in 2011.

·         Written for Justice repeatedly  to the following but all to no avail-

1.       CEO-SRA

2.       BMC Commissioner

3.       Housing Minister-Mr. Sachin Ahire

4.       Chief Minister-Mr. Prithviraj Chavan.

·         June 2011 Asst Commsr once again writes to SRA to hear us & give us a judgment but till date no movement.

Request for your kind guidance to  assist us ,get back our ancestral premises & bring us back to business & livelihood which we are out since 12 May 2010.

It shall be better for you to engage the service of a local lawyer as your matter is complicated which requires sudy of various documents in your hand.
