Need a good lawyer well versed in service matters

Brief background: Miss A was employed as a lecturer in a college in Faridabad, Haryana. She is not working there anymore, having resigned from her job. The resignation was accepted.  All contractual terms were adhered to by Miss A.

She started work as a lecturer in June 2006 and left in July 2011 (after completing just over 5 years of service)

Issues: The college has withheld various dues, and has not paid them despite reminders. These dues relate to various deductions and arrears. We think that Miss A is also owed gratuity because she has completed five years' of service. The college has also not provided some of the paperwork that they should have.

Required: We need a good lawyer to pursue this case with the employers. The lawyer should be well versed in service matters (Employment Law etc) and should be able to communicate well in English; someone who could take up the case and follow through with complete dedication. Reasonable remuneration will be considered. Thanks.

P.S : Apologies if this kind of topic should not be posted here. Please excuse our ignorance.

I have gone through the contents. The facts stated in relation to the grievences are "relevant". Other facts are "irrelevant and hence ignored". An employee, who completes the statutory period to qualify either under the Act, or the rules and or the scheme, would be certainly eligible to claim the benefits prescribed under the "existing law". The matter should be carried on with the "specified authority" under the Act, who would exercise the statutory power, authority and jurisdiction to pass appropriate order in this behalf.

Just state the facts and circumstances of the case, the deprivation made, and ask them to set right the position failing which appropriate actions will be taken against the erring officers with a further relief to fasten those erring officers with a responsibility to share from their pocket.

This is a forum to difuse the mental agony and confusion of the clients, who have suffered the injustice. It is generally free of cost advise. We do not solicit the instructions generally, unless specifically asked for. It is advisable that a local lawyer may be contacted in this behalf.

Thank you very much Mr Hemang. Your contribution is highly appreciated. We would certainly try to seek redress to our grievances, and try to find a local lawyer. This was the main reason that we came to this site and made our original request.

Can you please shed some light on who the 'specified authority' in this case is.

The university in this instance is a private university, approved and authorised by the relevant ministry, but notorious for treating its employees badly.

I hope we have been able to clarify as much as we could, but if there's anything that needs to be further clarified, please do let us know. Thank you once again.

Ashwin
