Hello Jagdish,
After going through your query, I understand your frustration with not receiving the judgment copy and here, I would like to give you a piece of advice that might help you out.
As far as I understood your query, I would like to tell you that even if you don’t have the actual copy of the judgment, you already have the PDF copy of the judgment which was verified and provided by the court itself.
This means that you are in a strong position to ask your lawyer to file the execution petition using the PDF copy of the judgment along with a properly verified affidavit stating the fact that the certified copy is still awaited.
Referring the Section 36 of the Code of Civil Procedure, 1908, you are free to file for the execution petition as long as the court is satisfied by the judgment that has been passed and the authentication of the PDF version of the judgment has been done properly.
If the court requires the certified copy of the judgment for the petition regarding the execution, then the certified copy of the judgment can be submitted once it arrives.
Still, I would like to suggest you please tell your lawyer to check for the certified copy of the judgment with the registry of the court and the court’s clerk to avoid any procedural issues or administrative backlogs because of the delay.
Go ahead with the execution petition by attaching the PDF copy of the judgment and please feel free to connect with me on LinkedIn if you need further follow-ups.
Thank You. (www.linkedin.com/in/pankhuri-rastogi-9221b2289)
