As my story is little big but i want to present all the truth and facts in front of you so you can provide me proper guideline what i should do further.
On 06/12/2013 i joined a leading Health Insurance company Head Office at Gurgaon as Sr.Channel Sales Manager and my work place was Bangalore and my channel was one of the PSU bank for selling Health Insurance for their Account Holder. By June2014 due to my business performance i was recognized as Pan India Top performer at my level in the organization.
Due to some of my personal problem in July 2014 i want to leave organization because i want to move my native place in Bihar and same time company has also position vacant in Bihar so my Manager told me to put request for transfer and they transfer me at Patna- Bihar in August-2014. There was huge service issue at Patna Circle which after i came resolve with the help of other colleague.
The PSU has started a new circle office in Purnea (Bihar) respective Area Manager (North-East) told me to handle the new circle from September since inception. As this circle mostly branches was untouched & very low penetration of our product but i was trying my best for better result.
In Nov.2014 after Diwali respective Area Manager (North-East) left the company and new person was joined even he also left within month time. On the occasion of Diwali it was told by previous Area manger through “Whats up”to give some gift to Circle Head & Marketing Nodel Officer and reimburse the amount through company petty cash but due to some reason i could not done and kept quite. In Dec.2014 this topic was raise in circle then new Area Manager told me to take Marketing staff for lunch and adjust bill in your traveling expense since now we cannot take approval. I have done the same and told the things to new Area Manager (who joined in Feb.2015-Mr. A..) in Month of March,15 traveling, adjusted amount in hotel room rent and send to him for approval.
Other side i was not aware that Mr.A.. wants to remove me and replace his person who was his ex colleague so after getting this bill with the help of HR (Ms.B). Both started to pressurize me to since i have done fraud so they will terminate me. Also took in writing over company mail that why i was adjusted my bill. When i have told that if they will terminate me i will go to court and i have couple of proof where you have insisted us to give gift to PSU employee.
After 2 month long threatening & harassment Ms.B told me that you send your resignation , so on 04/06/2015 i send mail to Mr.A.. And the same he was approved on 17/06/2015 and till 22nd June’15 i was worked at Purnea and by 24/06/2015 i came to Patna on my own cost to return company assets.
But in 13-August-2015 i have received my Full & Final(F&F) settlement which was nothing as i was expecting (Salary+ Traveling expenses). I have waited till 25th August’15 for F&F letter after not receiving send mail to Ms.B Then on 8th September’15 she send my relieving letter through mail where i saw that my last working date is 4th June 2015. Very same day i have sent mail to only Ms.B about my last working date is wrong and started doing follow up with her and some other reason she was giving excuse. when on 8th October’15 have sent reminder mail to her & CC to Payroll dept then Payroll team replied on 9th Oct. as Ms.B is on leave they will response by Monday(12/10/2015) but there was no communication received till 27th Oct so on 28th October’15 i have sent again reminder mail to Payroll dept and this time CC to her and her bosses immediately she replied that Mr. A has confirm that your last working date is 4th June so accordingly we prepare F&F. Then on 30th Oct. I replied her mail that i am not satisfied with your answer which you took 2 months time kindly re look the matter. Then by 8th December 2015 they clear my all dues approx.25k but that traveling was not paid to me.
Now due to delay in my F&F approx 6 month i was job less because i don’t have proper work experience letter. Thanks to my family & friends in worst situation they were with me we could survive, children school fees are paid.
Kindly suggest if they have found me guilty why not they terminated me because the kind of harassment done by company i am now completely upset ,it has effected me mentally getting fear to join anywhere.
Kindly suggest me what i should do now. Is they are correct or I should go legal for compensation.
Shall i file case against Company, Person who signed my first reliving letter without checking document properly, Mr. A who given wrong information and Mr. B hold issue such a long time.
