Neglect

A DV case is going on between husband and wife and they are protestants   . The wife has taken away the child and is staying seperately at her mothers place . Visitation has been applied by the husband and not yet granted .The wife is denying the child from attending mass and sunday school which is compulsary for christans . Can a DV case be filed on behalf of the child by the husband against the Wife and a order be passed so that the child should be made to attend mass and sunday school be it either with the husband or the wife .

The husband can agitate this ground at the time of decision of the application for visitation rights. The welfare of the child includes the child's moral and religious welfare. If the woman is deliberately denying that - it may make out a strong case in favour of the father.
