Noc not taken earlier,sought before interview-lien denied

sir,i am working in railways,appointed on 14.12.12 ,no training provided.after joining in railways,in  response to notification dated 25.11.13 for online application for higher scale post by rajasthan state,applied online in december 2013.the notification asked only rajasthan state govt employees to take noc before applying.hence i didn't take permission for applying and written examination.but before interview i applied for noc but in time reply not received hence taken leave,by leave application also communicated that i want to attend particular interview.i attended interview and got selected.afterwards received reply to noc application in which they asked noc for application or written exam.now lien being refused verbally.may i claim technical resignation as right or should go after resign without lien? whether applying and writing exam without permission during probation can attract misconduct rules?

please provide citations and relevant rules-

1.noc may be sought anytime during recruitment process ie before interview also.

2.if noc from central govt employees is not sought in particular notification and in interview also than is it mandatory to take noc in order to secure lien on post?

3.noc is right or discretion when no public interest is involved and going to much higher post?
