Can a housing association under the Maharashtra Apartment Ownership Act charge non - occupancy charges in addition to maintainence charges . An Association of Apartments is only concernecd with the maintainence of common area ,so how can they charge non -occpancy charges .
Further the notification of State Governemt is that non-occupancy charges cannot exceed 10% of service charges , is this notification applicable to a housing Association registerd under the Apartments Act since the notification is issued under the Societies Registration Act.
Can any legal expert give the proper analysis of the above questions
