Non payment of dues

Dear Sir, I am working in an NGO based organisation where I am also a trustee without holding any office bearing post.This is my only full time job for which I am taking a fixed professional fee every month.The organisation has been irregular in paying my salary/fee in 2015 and 2016 and has not paid me since December 2016 saying the organisation does not have enough funds to pay the trustees. Even after being communicated that I want to leave the organisation,the President is neither releasing my recent pays nor making a full and final settlement.Even after being communicated that I have an ongoing home loan above my other liabilities,they are turning a deaf ear to my repeated requests.My family is in a tight financial corner due to this.Kindly advise on how to proceed on getting a full and final settlement or at least getting a recent salary released. Report the same to Local Asst.Commissioner of Labour and also contact Advocate for issuing noticce demanding for payment of salary as a first step.

Please be clear whether you are entitled to salary or professional/ consultancy charges?

 

As already advised above, for your dues you may send a notice demanding the same to be cleared at the earliest. Failing which you may approach the appropriate legal forum/ authority to recover the same depending on your nature of employment, nature of company and strength, tenure of service, last drawn wages etc.

It is FEE or Salary?

Once it is clarified then you can move further.

If it is FEE and/or you are not covered by umbrella of labor Laws and/or it is civil dispute the limitation of 3 years may stare at you.

You have already given a very long rope.

Act ASAP.
