Notice to non-applicant

I have filed petition HMP sec.9 on 24-7-17 in Nashik family court as both resides here n first date given as 24-11-17. Notice issue to non applicant. I appear on date but court clerk says notice report was not rec'd till. Non applicant resides approx 10 km from court in easy accessible civil area. I have doubt of some malpractice in it. Whether mere notice take so much time ? and who is the authority if I want to make complaint for that. Pl suggest. Thanks.
