Nri travel to india suspecting 498a

Hi All,

My wife wants a divorce and is demanding a huge alimony which i am unable to pay. I am planning to travel to India in dec to meet my family but have been advised by many people not to come to India including my lawyers as wife might file 498a when i travel to india and i might get arrest from the airport itself. She is from delhi.

I understand that the police will do investigation first and then only they will arrest based on getting approval from magistrate if there is any evidence. My questions

1) Can the police arrest me without any evidence as soon as i land in india?

2) I cannot file for AB as i  suspect she might file 498a based on their aggresive attitude. Are there any other precautions which i can take. ?

Any help would be great.

*** Take my reply as suggestion, if in case you are innocent....If you have done something seriously offensive against your wife, do not

take my suggestion. Drop it off. I am against women being victimized. ***

Allow matters to cool for another one year.

Give time.

After that, come by connecting flight.

Reach Andaman Nicobar and from there travel wherever you want.

Legal Paperwork, definitely they will arrest you since your arrest will mean so much of money to the

corrupt ones among the police.

why do you want to come now ???

Unless it is urgent or emergency, stay where you are, for another year.

@Natarajan :- Thanks a ton for your valuable input. I really appreciate your help. I guess i will not travel to India at this point of time.I wanted to come to India because i wanted to meet my family as i miss them. Also since i know i have not done anything wrong and am innocent i was thinking why should i hide from anyone. But unfortunately i guess that is not how it works. I will try and get visa done for my family so that they can visit me instead.

@Raj123:- Thanks a lot for your valuable advise. As advised by other experts i think i will postpone my India trip till the matter cools off..Again, Thanks a lot for your help. It is much appreciated.
