Occupancy certifucate not received but possession given by b

I had purchased a flat at vasai in 2009 and got possesion on same from builder directly . Occupancy certificate is NOT taken by builder but handed over possesion , formed co operative housing society too, Vasai virar mahanagarpalika is charging property tax too. and collecting also.

My questions

1)   if occupancy certifitcate is not taken by builder how muncipality allows flat owners to stay

2) what can be done to safe on legel front and natural clamities and disasters

3) any more suggestion to safeguard our money n property

I am sorry to state....BUILDER has NOT TAKEN OCCUPANCY CERTIFICATE YET.....but there is some words missing in original querry

Dear Rajiv.

 

You should not have taken possession of the flat till the builder gets an OC. If I’m not wrong the municipality charges buildings that don’t have an OC at twice the normal rate at which it charges building that have an OC.

 

Luckily for you the government is coming out with new rules to help people who have taken possession but don’t have an OC. These new rule are expected to come in 6 months time. So the best thing is to wait for the rules to come into affect. Then the society can apply for an OC directly.

Dear Rajiv,

 

As I have mentioned above new rules will come out soon. You should wait for them to become into affect, then your society will be able to directly apply for an OC. You will most probably have to some extra amount to get it .

 

We should all be very careful when we are dealing with these builders, never trust anything they say.
