One family falsely accused under 498a and 354a

Hi Experts,

One family (husband and parents) have been falsely accused of IPC 498A and the father in law of 70 years has been seperately accused of IPC 354 (s*xual harassment).

They have been arrested same day. My question is:

Should section 41A have been followed before arrest?

What can be done for a quick relief to the aggrieved family?

Regards,

Saurabh.

Have you applied for bail or not?

This is not my case, but someone I know. They have hired a lawyer for these processes.

Case registered and police came suddenly so no time for AB.

Apply for bail before Magistrate and it gets refused go to appeal before ASJ and there also if bail is not granted then approach HC for bail.

IPC 354 is non-bailable that's why they filed this case.

Apply for bail immediately before Magistrate.

In case of rejection, apply for bail before the Session court (ASJ).

Even if, bail is not granted, then appeal to the High Court against the Session Court judge's decision.
