Dear Querist,

When a person forgoes his possession of the property - and lets another possess for 12 years in a hostile manner and against his interests and does not sue for possession. The Law takes away from him the right to sue alongwith the right of ownership. Adverse Possession as a principle is based on fact 'that if a person is not concerned about his property and has left it in disuse - he is presumed to have abandoned it'.

It appplies on flats too !
