Hi.... I have A query for you.
a girl married to a boy but after one and half year they get divorce in the panchayat and the matter was over....no issue from that marriage...
boy and girl bothe remarrid to some other person...
the girl who remarried to the second person does not treat her well....she filed complaint u/s 406,498A. in which simmons have been issued and now on Evidence. the court also grant interim mainatance to the girl....
and the boy filed divorce petition.
and very interestingle the Ld Court said that their first marriage is not dissolved through the proper divorce decree so the second marriage is not legal marriage and the Court dismissed the divorce petition.
now what is the remedy available to the girl because the boy can easily escape from the liability by merely proving this that her first marriage was not dissolved legally.. lthough he could be penalised for adultry in such condtion but what are the other remedies available to the girl?
