Hmmm,

 

I don't think these sections are attracted, even if your story is accepted by the court. It is more of a case of illegal confinement.

Coming to your query:

 

It seems that the only thing you are concerned about is "Arrest of the Accused (your in-laws)"; the chances of same happening through the private complaint is very bleak. I am listing the procedure for your perusal

 

1. Give the complaint in the PS; where the crime was committed; if they refuse to accept the complaint send it by post.

2. After 7-10 days; file a case u/s 156(3) r/w s. 200 of CrPC in the court.

3. The court would ask for ATR from Police Station (Maybe 2-3 months)

4. As you say; the police is hand and glove with your in-laws; they would give negative report.

5. The court would then ask you to lead pre-summoning evidence (If it still accept your case); Pre-summoning evidence would take 3-4 months.

 

However God may have its own designs and He may get your in-laws arrested in any other way.

Oh I forgot to mention that it would be around 6-8 months before the accused are summoned; arrested; I can not say.

Dear Srinivas,

 

You have woken to this after such a long delay. I don't want you to cry, but then, I won't advise you to take steps which leads to dead end. That would mean that you would cry more and get dejected.

in-laws have file case.  Either defend it (face it) or avoid it (if you can.

Private complain is costly and time consuming if you don't do in-person and make speedy trial from High Court.

 

My opinion is file FIR first. If police does not take then complain to SP. If still SP does not take any action then file Writ (Article 226) petition to give direction to the state to register FIR against them.

Just to remember you that a complainant also have right for Speedy Trial. :)
