Partion deed

Partion deed done in 2002 daughter not signed the partion deed father died in 2002 and daughter not gave property , according to the yesterday supreme Court judgement they can claim the yesterday

The property was partitioned in 2002, and daughter is aware of such partition and not raised any objection even after 18 years.   There is limitation period for such claims also.

1. "IF"  Partition Deed was not duly executed & signed in 2002 between Father & Daughter, THEN such Partition Deed without signatures is infructuous, for all legal purposes.  IF a Partition Deed is prepared for Family Property, THEN  "ALL" family members MUST COMPULSORILY sign, as consenting parties, even though they may not be the beneficiaries.  A Partition Deed signed between selected Family members by excluding some other selected family members, is legally null & void.

2. By virtue of above, Daughter is entitled to claim her share in Family's Property, without any exceptions.

When was the deed signed?

Who were the signatories?

When did the father die?

Who were his legal heirs?

3 daughter and 3 sons but 3 daughter did not signed the partion deed

Father died in 2003

3 son and 3 daughter

According to the yesterday supreme court judgement that father is alive or dead does not matter so they can claim property ?

Sir i I forget when partion deed was signed so after confirming so I posted sorry for the mistake
